The Court rules as follows on defendant's motion to set a case progression plan and for relief from the trial setting conference. The motion to set a case progression plan is granted. The motion for relief from February 5, 2007 trial setting conference is denied. In October, 2006 this Court granted defendants' motion for relief from the case management program. California Rules of Court, rule 209 provides in pertinent part that if the court exempts the case from the case disposition time goals, the court must establish a case progression plan and monitor the case to ensure timely disposition consistent with the exceptional circumstances, with the goal of disposing of the case within three years. (Emphasis added) Thus, a case progression plan is required. The main thrust of defendants' motion is to seek continuance of the trial setting conference date. They offer little in the way of concrete suggestions for a case progression plan, other than that they need time to make, and for the court to rule on, dispositive motions and there may be the possibility of mediation. Plaintiffs contend this is a delaying tactic so that this case will go to trial after the federal case set for September. The trial setting conference was ordered last July and there has been a de facto management plan in effect, paralleling the one set in the federal court. Virtually all discovery, including expert witness discovery, has been completed. Plaintiff contends that the only management the case needs is to have a trial date set. The Court agrees with plaintiff. Defendants have had ample notice of the trial setting date and more than enough time to secure a date, and file motions, for summary judgment. The fact that they have not done so is not good cause for vacating the trial setting conference. The only additional case management required is to have this matter set for trial. The court now establishes as the case management plan that this matter proceed to trial setting conference on February 5, 2007 and that discovery and motion timelines and cut-offs be governed by the trial date set at that conference.
